About ENC

Educate the Needy Children (ENC) is a nonprofit organization registered in the United States of America in 2011. ENC is recognized as a tax-exempt public charity under the U.S. Internal Revenue Code Section 501(c)(3), EIN: 27-3228417.

ENC is run entirely by volunteers and board members who accept no remuneration for their service. ENC's primary mission is to provide educational access and need-based scholarships to underprivileged children in Nepal, in partnership with its Nepal-based partner organization, ShivaMaya Educate the Children Organisation (SETCO), based in Bhattedanda, Lalitpur District, Nepal.

Section 02

Acceptance of Terms

By accessing or using the ENC website (edunc.org), submitting a donation, or enrolling in the sponsorship program, you agree to these Terms and Conditions in full. If you do not agree with any part of these terms, please do not use our website or submit any payments.

These terms apply to all visitors, donors, sponsors, and any other users of the ENC website or services.

Section 03

Donations & Payments

ENC accepts donations through the following methods: PayPal, Zelle, Venmo, and personal checks mailed to our address. By making a donation, you confirm that:

  • You are the authorized owner of the payment account used.
  • The funds donated are lawfully obtained and are your own.
  • You are making the donation voluntarily and without expectation of goods or services in return, except as otherwise stated in our sponsorship program.
  • All donation information provided is accurate and complete.

All donations are final and non-refundable unless ENC determines, at its sole discretion, that a refund is warranted due to a documented processing error. Refund requests must be submitted to educateneedy@gmail.com within 30 days of the transaction date.

ENC does not store or process payment card data directly. Third-party payment processors (PayPal, Zelle, Venmo) handle all financial transactions subject to their own terms and privacy policies.

Section 04

Tax-Exempt Status

ENC is recognized by the U.S. Internal Revenue Service (IRS) as a 501(c)(3) tax-exempt public charity. Donations made to ENC are generally tax-deductible to the extent permitted by U.S. law.

You may verify ENC's tax-exempt status at any time by searching EIN 27-3228417 on the IRS Tax Exempt Organization Search at apps.irs.gov/app/eos/.

ENC does not provide individual tax advice. Please consult a qualified tax professional to confirm the deductibility of your specific donation based on your personal circumstances.

Upon request, ENC will provide a written acknowledgment of donations of $250 or more as required by the IRS. For contributions below $250, your bank or payment processor statement may serve as a receipt.

Section 05

Use of Funds

ENC is committed to maximum transparency in the use of donated funds. 100% of all donations received go directly to program activities in Nepal. All operational overheads, including website maintenance, administrative costs, and volunteer expenses, are covered by ENC board members and volunteers.

Donated funds are primarily used for:

  • Need-based cash and in-kind scholarships (school bags, supplies, clothing) for children in Grades 1–12.
  • Personality Development Training (PDT) — residential training programs conducted twice yearly for students in Grades 8–12.
  • Food support for the poorest 15–20% of sponsored children.
  • Maintenance and operations of the SSN Learning Center (Shiva Maya Shanti Niketan) in Bhattedanda, Nepal.
  • Teacher training and school monitoring programs conducted by SETCO.

ENC reserves the right to allocate funds across program areas as it deems most beneficial to its mission and the children it serves, in consultation with SETCO. Pooled donations of any amount are combined with other contributions to maximize collective impact.

Section 06

Sponsorship Program

ENC's child sponsorship program allows donors to support specific children or contribute to a general pool. By enrolling as a sponsor, you acknowledge and agree to the following:

  • Sponsorships are not legally binding contracts and may be modified or terminated by either party with reasonable notice.
  • ENC and SETCO reserve the right to select and match children to sponsors based on eligibility criteria including level of need, gender, community background, and parental commitment.
  • Sponsors who wish to remain anonymous may request this in writing and ENC will honor such requests to the extent possible.
  • ENC will endeavor to provide sponsors with regular updates on their sponsored child's progress, school attendance, and academic performance — at least once per year.
  • ENC cannot guarantee continuous sponsorship of a specific child if that child drops out of school, relocates, or otherwise becomes ineligible under SETCO's monitoring criteria.
  • In such cases, ENC will notify the sponsor and offer to redirect the sponsorship to another eligible child.

Scholarship conditions require that sponsored children maintain 80% or above school attendance and that parents ensure homework is completed. Failure to meet these conditions may result in temporary suspension of the scholarship.

Section 07

Privacy & Data

ENC collects personal information (such as name, email address, mailing address, and phone number) solely for the purpose of processing donations, managing sponsorships, and communicating program updates to donors and sponsors.

ENC does not sell, rent, trade, or otherwise share your personal information with third parties for commercial purposes. Your data may be shared with SETCO in Nepal solely to facilitate the management of your sponsorship.

  • You may request access to, correction of, or deletion of your personal data at any time by contacting us at educateneedy@gmail.com.
  • ENC may use your email address to send program updates, newsletters, and annual impact reports. You may opt out of such communications at any time.
  • Photos or stories of sponsored children shared on our website are done with appropriate consent and in compliance with child safeguarding principles.

By using our website and submitting your information, you consent to ENC's collection and use of your data as described above.

Website Use

The ENC website is provided for informational and donation purposes only. You agree not to:

  • Use the website for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorized access to any part of the website or its systems.
  • Transmit any harmful, offensive, or disruptive content through any forms or communication channels on the website.
  • Reproduce, distribute, or commercially exploit any content from the website without prior written permission from ENC.
  • Use automated scripts, bots, or scrapers to access or extract information from the website.

ENC reserves the right to restrict or terminate access to the website for any user who violates these terms.

Intellectual Property

All content on the ENC website — including but not limited to text, photographs, graphics, logos, and program descriptions — is the property of Educate the Needy Children (ENC) or its content contributors, and is protected by applicable copyright and intellectual property laws.

You may share or link to ENC's content for non-commercial awareness purposes, provided that you clearly attribute the content to ENC and do not alter or misrepresent it. Any other use requires prior written consent from ENC.

Disclaimers

The ENC website and its content are provided on an "as is" basis without warranties of any kind, either express or implied. ENC does not warrant that:

  • The website will be uninterrupted, error-free, or free of viruses or harmful components.
  • The information on the website is always current, complete, or accurate.
  • Any specific outcome will result from a donation or sponsorship, beyond ENC's best efforts to fulfill its stated mission.

Links to third-party websites (such as PayPal, Zelle, Venmo, or the IRS) are provided for convenience only. ENC does not endorse or take responsibility for the content or practices of third-party sites.

Section 11

Limitation of Liability

To the fullest extent permitted by law, ENC, its board members, officers, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the ENC website.
  • Any errors or omissions in website content.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct or content linked from the ENC website.

ENC's total liability to you for any claim arising from these terms or your use of the website shall not exceed the total amount donated by you to ENC in the twelve months preceding the claim.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Illinois, USA. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
